Depending on the state, the land records office may also go by the names "Recorder's Office" or "Clerk of Deeds," and it is typically located at the county level. Only when explicit actions are performed to transfer the property to the lawful heirs are the records updated. In most situations, a probate case is opened (with or without a will), and the transfer of the real estate is supervised by the court. The executor or administrator registers a deed in the office of land records after the probate procedure is complete to formally record the transfer of title to the new owner(s).
